R v. Hamilton (and Mason), [2004] O.J. No. 3252
This case was an appeal by the Crown against the sentences given to three drug couriers. In the cases, the trial judges took into account the circumstances of black women and the provisions of section 718.2(e) of the Criminal Code. ALS intervened in the case to provide our perspective on the application of this section in criminal sentencing. The Crown was largely successful at the Court of Appeal. Leave to appeal to the Supreme Court of Canada in the Spencer matter has been requested.
